Terms and Conditions

The following agreement sets out the terms and conditions applicable to members of the services operated by EzLance.com. Applicants (referred to also as "members) must be in agreeance to the following terms and conditions. A member's failure to comply with or in the event of breach with/of any provision of the following terms and conditions, then in addition to any other remedy available to EzLance, termination of participation in membership services and /or withholding of payments relating to participation in EzLance services.
ELIGIBILITY REQUIREMENTS
Participation in the services and the application process is at the sole and absolute discretion of EzLance.com.
REMOVAL FROM NETWORK
EzLance.com reserves the right to terminate the participation of any member or site at any time without reason. Including any members or member sites that violates the terms and conditions.
Violaters of terms and conditions will have their membership deactivated immediately.
Members can be deactivate by EzLance. com with no prior notification.
EzLance will not issue any credit or
payment for members found in violation of terms and conditions. In the event a membeship is terminated by EzLance on any basis other than
violation of these Terms and Conditions, member will be entitled to receive any payment due from
EzLance.
REFERRAL COMMISSIONS
Commission for referrals will be paid out as listed on the Referrals page (http://www.EzLance.com/referrals.shtml). In the event a commission rate is changed, it will affect referrals made after the new commission rate was posted. Referral of yourself and signing up for multiple accounts is prohibited and will not be eligible for the collection of referral fees. We prohibit partnering with another EzLance member and sharing/transfering of the commissions made from your own account, in this event both members will be terminated from the service without payment. In the event we believe the referred user will not pay the fees they were charged, since referral commissions are based upon those fees, EzLance reserves the right to delay or cancel the processing of referral earnings.
PAYMENTS
At the requests of a member AND if their account balance is equal to or greater than $30, EzLance will typically print and mail checks.. This would include payments made through PayPal services. Amounts are stated in U.S. funds and payments will be made in US funds. All deposits are verifed by EzLance and we may request that you to verify your deposit; in the event you refuse to send verification information via E-mail, Fax or Phone, we reserve the right to refund the deposit and terminate your account. In the event that funds are suspected to be fraudulent, EzLance reserves the right to terminate/suspend a withdrawal. Any account having made a fraudulent deposit, funds will be reversed immediately. In the event of a fraudulent payment situation where a withdrawal has already been processed, funds you will be expected to return funds to your EzLance account. Failure to return funds will result in your account being terminated.
Any member site that EzLance removes from the service
due to violation of the Terms and Conditions will receive no credit or payment.
COPYRIGHTS
The posting of copyright material on EzLance is prohibited.. Scripts which are sold by the author are included. Sections of these scripts may be posted,as examples will be permitted. A "section" being defined as no more than 10% of the script's contents. This is in place in order to protect the author's rights.
MODIFICATIONS
EzLance reserves the right to ammend Members Terms and Conditions at any time. Terms and Conditions should be reviewed from time to time for such
changes, this is the sole responsibility of the member. Any additional or replacement services offered by EzLane then this
agreement shall apply to such services in the absence of any new agreement specific to
such services which is entered into between the parties.
OWNERSHIP
Members are in agreeance that all information contained on this website operated by EzLance and all information compiled by EzLance through operation of the affiliate
program, is the proprietary information of EzLance. EzLance will keep personal information provided by members confidential and will not distribute to any third
party.
E-MAIL ADDRESSES
E-mail address' should not be posted on the site, with the exception of the "e-mail" field on the signup form or when prompted by EzLance at any other time. You e-mail is automatically provided if you choose a programmer (or you are the programmer chosen for a project) and previous to that you can utilize the message board to communicate. This applies to all methods of communication, including phone, AIM,ICQ, MSN, etc. For further explanation please see "Avoiding Commissions" below:
PROVIDING CONTACT INFORMATION
Diirect contact with another member is prohibited, unless it's for a project you (a programmer) have been picked for or you (a webmaster) have picked a programmer for. Contact includes providing your e-mail address, ICQ number, phone number or any other method of contact outside of this site. Message boards are provided by EzLance for contact which is sufficient for pre-project communication.. "Featured" projects (look for special graphic) are the only exceptions, this means the webmaster has paid a fee in advance and you are allowed to provide contact information in the message board. Please note featured and non-featured message board posts on EzLance system do not distinguish so a warning message will pop up when submitting an e-mail address.
AVOIDING COMMISSIONS
Attempting to negotiate the fee for a project with another member directly (outside of EzLance) after that project has been created/opened and prior to that project being closed is prohibited. This applies to any project that was closed without a programmer being chosen and inquiring about the project anyway. EzLance should be notifed if the payment amount increases (above the bid amount) after the project is closed, this is the responsiblity of both members. If we are not notified and you receive a larger amount than the original project bid, this will be considered an attempt to avoid the commissions. All payments received for each project are reviewed to ensure that they match the bid when a programmer requests a withdrawal.. Failure to notify EzLance staff at the time of a withdrawal request, payment received above the amount of the bid ( total payment above $100 US) we reserve the right to deduct double the fee for the amount that should have been reported. This type of activity will not be tolerated on EzLance as our commissions are justified.
BIDDING
Bids placed must be equal to the total amount of money they are requesting for the project. Hourly bids or any other abnormal type of bid can not be posted, this applies to both programmers and webmasters. Projects cannot be created that directly or indirectly require programmers to place hourly or other abnormal bids. Featured projects,for both webmasters and programmers, are the exceptions. FEATURED PROJECTS
In order to protect the "Featured project" feature on EzLance the following conditions are in place. For a Featured project the maximum amount of money a programmer can receive through EzLance system, without being charged fees is $2,500. Amounts received above $2,500 will be subject to the regular fee of 3%. This only applies to money received with the EzLance system. If the payment is made outside of the EzLance system, you can recieve more than $2,500 for a Featured Project without being charged a fee. Members must notify us if the payment is received on EzLance in order for us to apply a 3% fee to the amount above $2,500. Failure to notify EzLance could result in temporary account suspension.
ADVERTISING
Advertising your website on EzLance is prohibited. Postings of any URL must be related to the bid, project description or message board. Your portfolio or resume is considered permissible URL.
EzLance's Role
EzLance has created a virtual marketplace to assist webmasters and programmers in connecting. EzLance is not directly involved in the actual transactions between users of the Site. EzLance has no control over the integrity, accuracy, quality, legality or safety of postings made by users. EzLance cannot and does not confirm the identity of users as it is difficult to verify the user on the internet. The qualifications, background or abilities of user is not confirmed nor verified by EzLance. Due to these reasons it is strongly recommended that users exercise common sense and good judgment when dealing with any member on the Site. Please review Project Guidlines before taking part in a project. If for some reason you are unsatisifed with another member, the most EzLance can do is refund the project commission you have been charged by us. EzLance is not responsible for your transactions, therefore we cannot refund any money you have sent to a member. EzLance is not and cannot be held responsible or liable for fraudulent payments made by users or for financial loss incurred from fraudulent transactions. It is sole responsibility of the reciever to verify the identity and background of the sender.
